While the majority of municipalities in the San Francisco Bay Area prohibit the purchase and discharge of fireworks during Independence Day celebrations, a select group of cities has opted to permit them. Dublin is among the few localities allowing residents to buy and set off fireworks, alongside Gilroy, Union City, Newark, and Cloverdale.
California state law restricts legal fireworks to "Safe and Sane" varieties that do not launch into the air, explode, or rise higher than 12 feet. Despite these state guidelines, many cities have implemented strict bans to mitigate fire risks. In contrast, the permitted cities began selling fireworks in late June, with sales continuing through the holiday weekend. Rules regarding discharge times vary by location; some jurisdictions prohibit fireworks after midnight on July 4, while others extend the window into the following day.
Penalties for violating local ordinances differ significantly across the region. In cities that ban fireworks entirely, such as San Jose, Oakland, Fremont, and Hayward, fines can be substantial. Violators in Hayward may face penalties up to $5,000, while those in San Jose could encounter fines ranging from $1,000 to $100,000 and potential jail time. In the permitted cities, illegal discharge in city parks or unincorporated areas of neighboring counties can result in fines exceeding $1,000.
Alameda County has introduced a new ordinance effective Friday that targets the illegal use of fireworks in unincorporated areas. This measure holds both property owners and tenants personally liable if they allow fireworks to be used on their land.
For those seeking legal displays, several communities are organizing public events. San Jose is hosting a Rose, White & Blue Parade and Festival, a neighborhood festival, and a drone show at Lake Cunningham Park. The city replaced its traditional pyrotechnic display last year following an explosion at its supplier’s warehouse in Yolo County. Gilroy will launch its annual show from Gilroy High School around 9:30 p.m. Santa Clara’s California’s Great America will present an all-ages show with music and dining options. Additionally, the Alameda County Fairgrounds in Pleasanton will host a fireworks display on Saturday evening.
